Terms and Conditions of Stay

Azelia Homes – Pune

By confirming a booking and/or checking into a serviced apartment managed by Azelia Homes (referred to as “The Management” or “We”), the Guest (referred to as “The Guest” or “You”) agrees to be bound by the following Terms and Conditions of Stay.

1. Booking, Payment, and Cancellation Policy

1.1. Confirmation of Booking: A booking is confirmed only upon receipt of the required advance payment or full payment, as specified in your reservation details, and a written confirmation from The Management.

1.2. Payment:

  • All prices are quoted in Indian Rupees (INR) unless otherwise specified.
  • Full payment is typically due at the time of booking for short stays, or prior to check-in/on a monthly basis for long stays.
  • We accept payments via UPI Payment,  Bank Transfer or  Cash].
  • Goods and Services Tax (GST) and any other applicable local or state taxes are chargeable at the prevailing rate and will be applied to the total bill, unless explicitly stated otherwise.

1.3. Security Deposit:

  • A refundable Security Deposit stay me be required upon check-in/booking.
  • This deposit is held against any damages, excessive cleaning, loss of keys/fobs, or outstanding charges.
  • The deposit will be refunded within 3 working days  after check-out, following a satisfactory inspection of the apartment and deduction of any outstanding liabilities.

1.4. Cancellation and Refund:

  • Short Stays (e.g., up to 7 days):
    • Cancellations made 7 days or more before check-in: 100% refund of the total booking amount, less a processing fee.
    • Cancellations made less than 4 days before check-in: 50% refund, less a processing fee.
    • Cancellations made less than 2 days before check-in: No refund.
  • Long Stays (e.g., 30 days or more):
    • Cancellations made 15 days or more before check-in: 75%  refund of the first month’s rent, less a processing fee.
    • If the Guest checks out early, a minimum notice period of 7 days is required. Failure to provide this notice may result in the forfeiture of a portion of the advance/security deposit equal to the number of days short of Notice period of 7 days.
  • No-Shows will be charged the full amount of the booking.

2. Check-in and Check-out

2.1. Check-in Time: 02:00 PM (Noon). Early check-in is subject to availability and may incur an additional charge.

2.2. Check-out Time: 11:00 AM. Late check-out is subject to availability and will incur an additional charge, which may be up to a full night’s stay tariff.

2.3. Guest Registration (Mandatory):

  • In compliance with local government regulations in Pune, all Guests (including all occupants) must present a valid government-issued photo identification (Aadhar Card, Passport, Driving License, etc.) upon check-in for record-keeping.
  • For Foreign Nationals: A valid Passport and Visa/OCI card are mandatory. The Management is required by law to complete a “C-Form” registration for all foreign guests. Failure to provide valid documents will result in the refusal of accommodation.

3. Usage of the Apartment and Conduct

3.1. Occupancy: The maximum number of occupants is strictly limited to the number specified in the booking confirmation. Exceeding this limit will result in additional charges or immediate termination of the stay without refund.

3.2. Purpose of Stay: The apartment is provided exclusively for temporary residential accommodation. It is not to be used for any commercial activity, illegal purpose, or any activity that causes nuisance or disturbance to other residents.

3.3. Noise and Nuisance: Guests must ensure noise levels are kept to a minimum, especially between 10:00 PM and 8:00 AM. Reports of excessive noise or anti-social behaviour may lead to the immediate termination of the stay and eviction.

3.4. Smoking Policy: All apartments and internal common areas are strictly Non-Smoking. Smoking is only permitted in designated outdoor areas. A penalty charge of ₹ 2000 will be applied to the security deposit if evidence of smoking is found inside the apartment.

3.5. Pets: Pets are not permitted on the property.

3.6. Housekeeping and Access: The Management, or its authorised personnel, shall have the right of access to the apartment at all reasonable times (and at all times in the case of an emergency) for cleaning, maintenance, and inspection, without prior notice to the Guests. Regular housekeeping schedules will be provided upon arrival.

4. Damages, Liability, and Indemnity

4.1. Damage to Property: The Guest is financially responsible for any loss, damage, or breakage to the apartment, its contents, or common areas caused by the Guest, their visitors, or any person for whom they are responsible. Costs for repair or replacement will be deducted from the Security Deposit, and the Guest will be liable for any excess costs.

4.2. Loss of Belongings: The Management is not responsible for any loss or damage to the Guest’s personal belongings, including valuables, cash, or electronics, from the apartment or any part of the property, including theft or pilferage. Guests are advised to keep cupboards, doors/windows locked at all times.

4.3. Hazardous Goods: Guests are prohibited from bringing or storing any raw, exposed, combustible, hazardous, or illegal goods, weapons, explosives, or illegal substances onto the property.

4.4. Indemnity: The Guest agrees to indemnify and hold harmless The Management from any claim, demand, liability, loss, or damage arising out of the Guest’s use of the apartment, including any injury or damage to third parties or their property, unless caused by the gross negligence of The Management.

5. Services and Utilities

5.1. Utilities: The accommodation price generally includes all standard utilities (water, electricity, gas, Wi-Fi, etc.). The Management reserves the right to apply a “Fair Usage” policy for electricity consumption in long-term stays, and excessive use may result in an additional charge.

5.2. Internet/Wi-Fi: While The Management strives to provide reliable Wi-Fi, it does not guarantee uninterrupted service and will not provide compensation for temporary outages beyond its control (e.g., service provider issues, power cuts).

5.3. TV/ Cable Tv: A Smart TV is provided in the apartment and all the free channels are viewable. The guest may log into their own account to view any other channels they wish to view.

6. General Legal Clauses

6.1. No Tenancy: The Guest is granted a license to occupy the serviced apartment for the period specified in the booking confirmation. This agreement does not create a landlord-tenant relationship or any form of tenancy rights under the Maharashtra Rent Control Act or any other relevant legislation.

6.2. Termination by Management: The Management reserves the right to terminate the stay immediately and without refund if the Guest breaches any of these Terms and Conditions, including non-payment of dues or violation of house rules.

6.3. Governing Law and Jurisdiction: These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India.
